QUA'AN-PAN LGC RECOVERS VEHICLES FROM FORMER CHAIRMAN
Qua'an Pan Local Government Council of Plateau State has recovered three of its vehicles from one of its former Chairmen, Hon Isaac Kyale Kwallu.
This followed a court judgement delivered by His Lordship, Justice S. D. Samchi on November 3, 2022 in Shendam, Plateau State.
The vehicles recovered from Hon Kwallu are, a Black Toyota Prado Jeep, a Silver Ford Ranger and a White Toyota Hilux Spec Van.
In the suit No PLD/SHD/92CV/2022 filed by Qua'an-Pan Local Government Council (Claimant) against the Chief Registrar (Deputy Sheriff); High Court of Justice, Plateau State; Chief Bailiff, the High Court of Justice, Jos, Plateau State; Attorney General, Plateau State and Hon Isaac Kyale Kwallu, the 1st, 2nd, 3rd and 4th defendants, respectively, the Court granted all the Reliefs sought by the Claimant.
The Claimant had sought for:
(1) A declaration, that by virtue of the Claimant's statutorily guaranteed existence by Section 7 of the Constitution of the Federal Republic of Nigeria and being the owner of the three vehicles namely - (i) Black Toyota Prado Jeep, (ii) Silver Ford Ranger and (iii) White Toyota Hilux Spec, which are currently in custody of the 1st and 2nd defendants , the Claimant is entitled to the delivery and possession for the vehicles for the use, custody and control.
(2) A declaration that by the combined effect of Sections 30(1), 33(1), 38(1)(3) of the Local Government Council Law 2016, upon the constitution and inauguration of Mr Ernest Abner Da'a, as the Executive Chairman of the Claimant's Local Government Council, since the 14th day of October 2021, the Claimant is entitled to have custody, possession and the use or control of any of the three vehicles namely, Black Toyota Prado Jeep, Silver Ford Ranger and White Toyota Hilux Spec, which belongs to the Claimant by virtue of Exhibits A, B and C are currently with the 1st and 2nd defendants; and
3. An order directing the 1st and 2nd defendants to forthwith deliver immediate possession of the three vehicles namely Black Toyota Prado Jeep, Silver Ford Ranger and White Toyota Hilux Spec, which belongs to the Claimant by virtue of Exhibits A, B and C, to the control and custody of the Claimant.
After reviewing the case, the Court held that by virtue of Ownership Documents attached in the said case the vehicles are the bonafide properties of the council and discountenance the argument of Hon. Kwallu that he was entitled to the said vehicles by virtue of his position as the former chairman of the council for lacking in merit.
The Court therefore ordered "That judgement is entered in favour of the Claimant and against the defendants," and further ordered that "all the reliefs sought by the Claimant are hereby granted as prayed."
The vehicles, which were in the custody of the Plateau State High court till this judgement were immediately released to the Council in compliance with the said Judgement.
